1. Definitions
In these terms and conditions, the following definitions apply:
- DN Ticket: DN Ticket V.O.F., established in Almelo.
- Platform: the online ticket sales environment of DN Ticket via www.dnticket.nl and subdomains.
- Organiser: the natural or legal person who sells tickets for events via DN Ticket.
- Visitor: the natural person who purchases a ticket via DN Ticket.
- Agreement: the agreement between the Visitor and the Organiser for the purchase of a ticket.
- User: any Organiser or Visitor who uses the Platform.
2. Applicability
- These general terms and conditions apply to all offers, agreements, services and deliveries of DN Ticket.
- Deviations are only valid if agreed in writing.
- General terms and conditions of Organisers or third parties do not apply.
3. Services of DN Ticket
- DN Ticket provides a Platform through which Organisers sell tickets to Visitors.
- DN Ticket does not organise events and is not responsible for the content, proceedings, safety or quality of events.
- The Platform may offer additional features such as access scanning, reporting and communication tools for Organisers.
- The Platform has been fully developed in the Netherlands. All data is stored exclusively on servers within the European Union, primarily in the Netherlands, Germany and France.
4. Role of DN Ticket
- DN Ticket acts exclusively as a technical intermediary and is not a party to the agreement between Visitor and Organiser.
- The purchase agreement for a ticket is always concluded between Visitor and Organiser. DN Ticket is not a party to that agreement and accepts no rights or obligations arising from it.
- DN Ticket may mediate between Visitor and Organiser upon request, but is not obliged to do so and assumes no payment or reimbursement obligation towards Visitors.
- All responsibility for the execution, content, communication and fulfilment of obligations towards Visitors rests solely with the Organiser.
5. Prices and Costs
- All unavoidable costs are included in the first displayed ticket price. Any variable per-order costs are stated directly and clearly alongside the price.
- No payment surcharges are charged for consumer card payments. If order costs apply, these are shown upfront and transparently.
6. Right of Withdrawal
- Tickets for leisure activities with a specific date or period are not subject to a right of withdrawal as referred to in Article 6:230p of the Dutch Civil Code.
- This is clearly stated prior to purchase, during the ordering process and in the confirmation.
7. Information Obligations
- Before completing the order, the following information is provided at a minimum: identity and contact details of the Organiser, characteristics of the ticket and event, total price including all costs, payment method, delivery method of e-tickets, relevant restrictions and information about the absence of the right of withdrawal.
- This pre-contractual information forms part of the agreement between Visitor and Organiser.
8. Liability and Outages
- DN Ticket endeavours to provide continuous and secure services, without guaranteeing uninterrupted operation.
- Temporary unavailability may occur due to outages, maintenance, updates or force majeure.
- DN Ticket is not liable for direct or indirect damages resulting from outages, downtime, data loss, errors or security incidents.
- DN Ticket is not liable for the performance of third parties such as Mollie, hosting providers and email services.
- In the event of force majeure, DN Ticket is not obliged to pay compensation. Examples include power outages, internet failures, cyberattacks, fire, pandemic, war, government measures and staff absence.
9. Payments and Payouts
- Visitors pay for tickets via Mollie. Mollie processes payments on behalf of the Organiser via the DN Ticket Platform.
- DN Ticket pays out to the Organiser by default once every 30 days, unless otherwise agreed in writing.
- DN Ticket may suspend payments or payouts in the event of suspected fraud or abuse, chargebacks, outages or an ongoing legal proceeding.
- Corrections to erroneous payments by Visitors are processed via the payment provider. DN Ticket is not liable for errors, delays or disruptions in payment traffic.
10. Fraud and Security
- DN Ticket monitors for fraudulent activities, duplicate accounts and unauthorised transactions and applies appropriate technical and organisational security measures.
- In the event of suspected misuse, DN Ticket may block accounts, withhold payouts or terminate the collaboration.
- DN Ticket operates a reporting point and notice-and-action procedure for allegedly unlawful content or events and handles reports carefully and within a reasonable timeframe.
- DN Ticket verifies the business details of Organisers and displays relevant company information to consumers in accordance with the requirements for online intermediaries.
- The Organiser indemnifies DN Ticket against damages, claims and fines arising from unlawful or misleading activities via their account or event.
11. Cancellation, Rescheduling and Refunds
- The purchase agreement for a ticket is concluded between the Visitor and the Organiser. DN Ticket facilitates the sale and is not a party to that agreement.
- In the event of cancellation or rescheduling of an event, the Organiser is responsible for timely communication with Visitors and for executing any refunds or rebooking, unless otherwise agreed in writing.
- Refunds are executed by or on behalf of the Organiser via the same payment method used for the purchase, unless otherwise determined by the Organiser. DN Ticket may facilitate the technical processing on behalf of the Organiser.
- DN Ticket is not obliged to provide restitution or compensation to Visitors in the event of cancellation, rescheduling or non-performance by the Organiser.
12. Transfer and Name Change
- Tickets are personal in principle. Transfer or name change is only possible if and to the extent that the Organiser permits this and under the conditions and costs set by the Organiser.
- Misuse such as unauthorised resale, publicly sharing QR codes or manipulation may result in invalidation of the ticket and blocking of the account.
13. Limitation of Liability
- Any liability of DN Ticket is limited to the amount paid out by the liability insurance. If no payment is made, the liability is limited to the total fees the Organiser paid to DN Ticket in the last three months.
- DN Ticket is not liable for indirect damages such as consequential losses, lost profits, data loss or reputational damage.
- DN Ticket is not liable for cancellation, date changes or other actions by the Organiser.
- DN Ticket is expressly not liable for damages or claims arising from the content, execution or failure to fulfil obligations by the Organiser towards Visitors or third parties.
14. Organiser Obligations
- The Organiser is responsible for correct event details, ticket prices, compliance with laws and regulations, fiscal obligations and customer communication.
- The Organiser publishes a clear refund and complaints policy and makes it available to Visitors prior to purchase.
- The Organiser fully indemnifies DN Ticket against all claims from Visitors or third parties arising from the event, ticket sales or the Organiser's acts or omissions.
- The Organiser acknowledges that DN Ticket solely provides a technical platform and bears no responsibility for the organisation, execution or fulfilment of obligations towards Visitors.
15. Privacy and Data Processing
- DN Ticket processes personal data in accordance with the GDPR and the privacy policy at www.dnticket.nl/privacy-policy.
- Organisers process visitor data as data controllers and independently comply with the GDPR. An appropriate data processing agreement is concluded with Organisers where applicable.
- For payment processing, the privacy policy of Mollie applies: mollie.com/en/privacy.
- All data is stored exclusively on servers within the European Union.
16. Complaints Procedure
- Complaints can be submitted via info@dnticket.nl or the contact form. DN Ticket confirms receipt and responds within 14 days with a substantive response or a timeline.
- Complaints relating to the execution of the event are handled by the Organiser. DN Ticket may forward the report to the Organiser.
17. Governing Law and Disputes
- These terms and conditions are governed by Dutch law.
- Disputes shall be submitted to the competent court in Overijssel, location Almelo.
18. Final Provisions
- DN Ticket may amend these terms and conditions. Amended terms take effect 14 days after publication, unless otherwise stated.
- If a provision is invalid or void, the remaining provisions remain fully in force.
